Mother's legal fight over tot's death

THE Northwich family of a baby who died after doctors were given permission to withhold treatment have vowed to take legal action against the hospital.

Luke Winston-Jones, who died last November aged 10 months, was born with the rare genetic disorder Edwards Syndrome which affects vital organs. He also had a hole in his heart.

The baby became the centre of a right-to-life battle which reached the High Court when doctors treating him at Alder Hey Hospital were granted permission to withhold aggressive lifesaving treatment if his condition deteriorated.

A year after his death, mother Ruth Winston-Jones is preparing to sue Alder Hey for clinical negligence, claiming that the doctors who were treating her son are responsible for his death.

The family, including Luke's aunt Jackie Kirkwood who lives at Lach Dennis, says it is not about money but relates to alleged actions on the night in question. An independent expert will now be brought in to review clinical and management procedures at Alder Hey around the time of Luke's death.

Mrs Winston-Jones, who used to live in Northwich and now resides in Holyhead, says she is pursuing legal action.

She said: 'Luke might be alive today if the doctors had made an effort to resuscitate him. This isn't about money, it's about getting justice for my son. The last year has been horrific, I can't believe they let my baby die.'

A spokeswoman said the Royal Liverpool Children's NHS Trust and the police investigated the incident and 'believe the Trust acted in accordance with the court's directions'.
